Types of Violations
There are three common violations that are issued. These violations include Department of Buildings (DOB) violations, Environmental Control Board (ECB)/(OATH) Violations, and Housing Preservation and Development (HPD) violations.
A violation may be issued on a particular property for various reasons. Some reasons a violation may be issued include random inspection done by the Department, a complaint submitted by a neighbor, work done without a permit (WWOP), safety concerns, or failing to correct an active violation.
Violations are issued by classes of severity and each come with a monetary civil penalty. Failure to comply or dismiss a violation can result in additional violations being issued, increases in civil penalties, Stop Work Orders (SWO), Job Holds (Job on Hold), and even criminal prosecutions.
It is extremely important to address any violation issued by any New York City governing agency.
NYC has been increasing its efforts to ensure violations are handled accordingly and have been diligently following up with property owners who do not remedy violating conditions.
